Company Philosophy

We started Bankruptcy Claim Exchange because the existing process for buying and selling bankruptcy claims is opaque and inefficient.

It makes sense for many creditors to sell their bankruptcy claims for immediate cash and limit their bankruptcy risks. It also makes sense for investors willing to make risky bets to buy claims in pursuit of gains or other investment strategies. However, there is no formal market or exchange for buying and selling claims in chapter 11 cases. This means:

(1) holders of bankruptcy claims cannot rely on market mechanisms to discover what their claim is worth or to evaluate offers to purchase their claim, making them less likely to sell when they should; and

(2) willing purchasers do not have easy access to claims they otherwise would buy, so

(3) the claims trading market is kept artificially small, ultimately to the detriment of creditors and investors.

We match willing sellers with purchasers to facilitate informed, arms-length negotiations, thereby replicating the market mechanisms that are missing in the current bankruptcy claims trading environment.

Although our process benefits buyers and sellers of bankruptcy claims, we provide extraordinary benefits to creditors in particular. Creditors of bankrupt debtors are involuntary investors in the debtor’s proceeding. Many creditors are unfamiliar with the bankruptcy process and the options available to them. We can provide practical insight into the bankruptcy process in general and to the case in which you become involved, which will allow you to make an informed decision on what to do with your claim.
